Heat-X CNC Pro Auto ← Back to Heat-X

Terms of Service & Disclaimer

Last updated: August 23, 2026 · These terms apply to the Heat-X CNC Pro Auto software and the data-gator.net licensing service, offered by Data-Gator.net (“we,” “us”).

1. Acceptance

By purchasing a license, activating the software, or using Heat-X CNC Pro Auto (the “Software”), you agree to these Terms. If you are using the Software on behalf of a company, you represent that you have authority to bind that company, and “you” means that company.

2. License

Subject to timely payment, we grant you a limited, non-exclusive, non-transferable license to install and use the Software. Each seat is bound to one machine; a Shop license covers the number of seats purchased. Licenses are subscriptions (monthly, annual, 3-year, or Shop annual) that renew automatically at the end of each term until canceled; if payment fails or the subscription is canceled, the license is suspended and the Software will stop functioning. You may release a seat from a machine yourself (in the Software or the billing portal) to move it to another machine. You may not copy (except for backup), redistribute, sublicense, rent, reverse engineer, decompile, or circumvent the license mechanism, except to the extent such a restriction is prohibited by law.

3. Verify every program — read this before you rely on the Software

CNC machining is inherently dangerous, and no software replaces a qualified machinist's judgment. Generated part programs must be reviewed and verified by a qualified CNC programmer or operator before they are run on a machine.

Until your facility's CNC programmers and machine operators are thoroughly familiar with how Heat-X CNC Pro Auto behaves, closely check every generated program. We strongly recommend spot-drilling all layouts with a very light spot — and inspecting the spotted pattern against the detail drawing — before committing to full drilling, until that level of comfort and confidence is reached at your facility.

You are solely responsible for the operation of your machines, the correctness of the programs you run, workholding, tooling, machine limits, and the safety of your personnel.

4. No warranty

THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE IS ERROR-FREE, THAT IT WILL OPERATE WITHOUT INTERRUPTION, OR THAT ANY GENERATED PROGRAM IS CORRECT OR SUITABLE FOR ANY PARTICULAR PART, MACHINE, MATERIAL, OR USE. NO ORAL OR WRITTEN INFORMATION PROVIDED BY US CREATES A WARRANTY.

5. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DATA-GATOR.NET, ITS OWNER, OR ITS SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, PARTS, MATERIALS, TOOLING, OR MACHINE TIME, OR FOR PERSONAL INJURY OR PROPERTY DAMAGE, ARISING OUT OF OR RELATED TO THE SOFTWARE OR THESE TERMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE LICENSE FEES YOU PAID FOR THE SOFTWARE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN EXCLUSIONS OR LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU; IN THAT CASE OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

6. Your responsibilities

7. Billing & cancellation

Payments are processed by Stripe; we never store your card details. You can update your payment method, view invoices, or cancel at any time via the billing portal. Cancellation stops future charges; the license remains active through the period already paid. Fees are non-refundable except where required by law. Promotional pricing applies only as described at checkout.

Renewal price. Your price is kept at each renewal for as long as the subscription renews without interruption. If a subscription lapses or is canceled and a new one is started later, the price then published applies. Published prices may change for new subscriptions at any time.

Seats. A Shop license's seat count can be raised at any time in the billing portal (charged pro rata for the rest of the term); a lower seat count takes effect at the next renewal.

8. Updates & support

While your subscription is active you receive software updates and email support (through the contact form). We may modify or discontinue features, provided the core function of the Software is not materially reduced during a paid period.

9. Termination

We may suspend or terminate a license for non-payment or breach of these Terms. Sections 4, 5, and 10 survive termination.

10. General

These Terms are governed by the laws of the State of Texas, USA, without regard to conflicts of law, and any dispute shall be brought in the state or federal courts located in Brazoria County, Texas. If any provision is held unenforceable, the remainder stays in effect. These Terms are the entire agreement regarding the Software and supersede any prior discussions.
